The Honorable Nicholas G. Garaufis of the Brooklyn U.S. District Court in Brooklyn, ordered that DACA, created by executive order of 2012 by President Obama, be restored by the Trump administration. DACA prevents undocumented young immigrants, whose parents brought them to the United States illegally when they were children, from being deported. The reinstatement requires that the Trump administration must now accept applications for DACA renewal and also from those who are now eligible.
DHS will now grant approved applicants work permits and deportation deferrals that will last for two years and allow DACA-holders to request permission to travel abroad under certain circumstances.
To be eligible for DACA applicants must:
- have arrived to the U.S. before they were 16;
- lived in the country since at least 2007;
- earned a high school diploma, a GED or served honorably in the military; and
- must not have any serious criminal records, including any felonies.
